1. Acceptance of Terms
By accessing or using the Big Uns Trading Cards website (bigunstradingcards.com), submitting a catch, creating an account, or making a purchase, you agree to be bound by these Terms of Service. If you do not agree, do not use the site.
2. Eligibility
This site is intended for a general audience. Users under 13 may not create their own account or submit personal information directly; a parent or guardian must complete any submission on their behalf, using the parent's own information. Users under 18 should have a parent or guardian involved in any purchase.
3. Accounts and the Locker
Creating an account gives you access to your personal Locker, where claimed cards, submissions, and Fingerlings raised in your Livewell are stored. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
4. Submissions
By submitting a catch (photo, name, lake, weight, lure, story, or other content), you grant Big Uns Trading Cards, LLC a non-exclusive, royalty-free, worldwide license to use, reproduce, and create derivative artwork from your submission for card production, marketing, and promotion. Submission does not guarantee selection or production as a card, and no payment of any kind increases the odds of selection. This license is further defined in the separate Submission Agreement, which governs specifically how submitted content may be used.
5. Purchases and Subscriptions
Packs, the optional social-handle display subscription, and any other paid products are subject to the pricing displayed at the time of purchase. All sales are final except as required by law or as separately stated in a refund policy. Subscription services renew automatically until cancelled by the user.
6. User Conduct
You agree not to:
- Submit false or fraudulent catch information.
- Attempt to claim, in the locker, a physical card that is not rightfully yours.
- Abuse, harass, or impersonate other users.
- Attempt to circumvent the site's security, QR verification, or claim system.
- Use the site for any unlawful purpose.
7. Intellectual Property
The Big Uns name, logo, card designs, game mechanics, and website content are the property of Big Uns Trading Cards, LLC and may not be reproduced without permission, except that users may share images of their own claimed cards for personal, non-commercial purposes.
8. Tournaments and Game Rules
Participation in tournaments, seasons, and related competitions is subject to the specific rules published for each event, which are incorporated into these Terms by reference.
9. Disclaimers
The site and all content are provided "as is" without warranties of any kind. Big Uns Trading Cards, LLC does not guarantee uninterrupted access, that any submission will be selected, or any specific outcome from gameplay.
10. Limitation of Liability
To the fullest extent permitted by law, Big Uns Trading Cards, LLC shall not be liable for indirect, incidental, or consequential damages arising from use of the site or its products.
11. Termination
Big Uns Trading Cards, LLC may suspend or terminate access to an account for violation of these Terms.
12. Governing Law
These Terms are governed by the laws of the State of Tennessee, without regard to conflict-of-law principles.
13. Changes to These Terms
These Terms may be updated from time to time. Continued use of the site after changes are posted constitutes acceptance of the updated Terms.
